These Discord Supplemental Terms (“Supplemental Terms”) constitute a legally binding agreement between EdgeFox & Co, doing business as Koda (“Koda,” “we,” “us,” or “our”) and any individual or entity (“you,” “your,” or “User”) who installs, authorizes, or uses the Koda Discord bot or any related services (collectively, the “Koda Bot”) within the Discord platform.
These Supplemental Terms are incorporated by reference into our primary Terms of Service and Privacy Policy and supplement those agreements. In the event of a conflict between these Supplemental Terms and our general Terms of Service, these Supplemental Terms shall govern solely with respect to the use of the Koda Bot within Discord.
By authorizing or using the Koda Bot, you acknowledge that you have read, understood, and agree to be bound by these Supplemental Terms.
I. RELATIONSHIP TO DISCORD
1.1 Third-Party Platform. Koda operates exclusively on the Discord platform, which is owned and controlled by Discord Inc. (“Discord”). Your use of the Koda Bot is therefore inherently subject to Discord’s Terms of Service, Privacy Policy, and Community Guidelines, as well as any other Discord rules, policies, or procedures in effect from time to time.
1.2 No Affiliation or Endorsement. Koda is an independent service developed and operated by EdgeFox & Co. We are not owned by, affiliated with, endorsed by, or sponsored by Discord. All references to Discord are strictly descriptive. Discord is not responsible for the operation, maintenance, or content of Koda, and we are solely responsible for the provision of the Koda Bot.
1.3 Precedence of Discord Terms. In the event of any inconsistency or conflict between these Supplemental Terms and Discord’s Terms of Service or Community Guidelines, the Discord policies shall control with respect to your right to access and use the Discord platform.
1.4 Dependency on Discord. You acknowledge that the Koda Bot relies entirely on the availability and stability of Discord’s APIs, systems, and services. We do not guarantee the continued availability of the Koda Bot in the event that Discord alters its APIs, imposes restrictions, or otherwise changes its platform in ways that limit our ability to provide the Koda Bot.
II. AUTHORIZATION AND ACCOUNT DATA
2.1 OAuth Authorization. By inviting or authorizing the Koda Bot into a Discord server, or by interacting with the Koda Bot, you expressly grant us authorization to collect and process data provided through Discord’s OAuth and API systems. This may include, without limitation, your Discord User ID, username, discriminator (tag), avatar, and server (guild) information.
2.2 Server Administrator Authorization. Where you authorize Koda for use within a server, you represent and warrant that you are duly authorized under that server’s policies and Discord’s rules to grant such access on behalf of the server. We are not responsible for disputes among server owners, administrators, or members regarding authorization.
2.3 Internal Identifiers. In addition to Discord-provided identifiers, Koda generates and assigns unique internal identifiers for each user and server to facilitate the operation of its features, including but not limited to moderation tracking, telemetry, usage logging, and premium feature management.
2.4 Revocation of Authorization. You may revoke Koda’s authorization at any time by removing the Koda Bot from your server or revoking its OAuth access through Discord. Revocation prevents further collection of new data but does not automatically delete historical datasets, which are retained in accordance with our Privacy Policy and data retention practices. Users may initiate deletion of historical datasets by invoking the `mydata` command or submitting a deletion request as outlined in the Privacy Policy.
III. SUPPLEMENTAL DATA COLLECTION
3.1 Message Content. Koda may process and temporarily or permanently store message content when: (a) a user invokes a command, (b) a message is subject to moderation logging (e.g., deletion, editing, flagging), or (c) a feature such as global chat, economy, or entertainment requires capture of message input. Such processing is feature-specific and occurs only as necessary to fulfill the requested functionality.
3.2 User Data. Beyond Discord’s OAuth data, Koda maintains supplemental datasets tied to users, which may include: moderation history (warnings, mutes, bans, and related case data); usage telemetry (commands executed, timestamps, latency, and error reporting); economy and entertainment data (virtual currency balances, inventories, and game participation records); premium subscription status and entitlements; and other metadata reasonably necessary to provide, secure, and improve the service.
3.3 Attachments. Where users upload or submit attachments (e.g., images, files, or other content) through Koda features, those attachments may be collected, stored, and served via our infrastructure, including domains operated by us such as
f.meetkoda.xyz
. Attachments are linked to your internal Koda identifier and may be retained for the purpose of providing logs, moderation evidence, or requested features.3.4 Platform Data. Koda may collect platform-related data provided by Discord’s APIs, including but not limited to guild/server identifiers, channel identifiers, role identifiers, server configurations, and audit log metadata. This information is necessary to support features such as role management, channel logging, server configuration, and cross-server utilities.
3.5 Technical and Telemetry Data. Koda may collect technical data, including Internet Protocol (IP) addresses, connection metadata, system logs, and telemetry statistics. Such information is collected for security, operational monitoring, abuse prevention, and performance optimization.
3.6 Retention. Supplemental data described in this Section is maintained only for as long as necessary to operate the service, comply with legal obligations, or enforce these Supplemental Terms. User-related metadata is automatically purged after ninety-one (91) consecutive days of inactivity, unless longer retention is required for legal compliance, dispute resolution, or abuse prevention.
3.7 User Responsibility for Data. You represent and warrant that you have the lawful right to submit, upload, or cause Koda to process any message content, attachments, or other data. You further agree that such data does not infringe on the rights of any third party, violate Discord’s policies, or contravene any applicable law.
IV. PREMIUM SUBSCRIPTIONS AND PAYMENTS
4.1 Discord-Handled Transactions. All premium subscriptions and related payments for Koda are processed exclusively through Discord’s Premium Apps system. We do not directly process, collect, or store credit card, bank account, or other payment credentials.
4.2 Subscription Management. Billing, renewal, cancellation, and refund requests are managed solely through Discord’s account settings. You are solely responsible for managing your subscription through your Discord account.
4.3 No Responsibility for Discord Processing. We disclaim any and all responsibility for errors, disputes, or issues arising from Discord’s processing of payments. Your remedies for payment disputes lie solely with Discord.
4.4 Complimentary or Comped Premium. From time to time, we may grant complimentary, promotional, or otherwise comped access to premium features of Koda (“Comped Premium”). Such access is provided at our sole discretion and may be revoked, modified, or terminated at any time without prior notice. Comped Premium is provided “as is” without any warranty of continued availability or renewal, and no user shall have a right or entitlement to such access. We shall not be liable for any damages, claims, or losses arising from the modification or termination of Comped Premium access.
V. DISCLAIMERS AND LIMITATIONS
5.1 Disclaimer of Warranties. KODA IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT.
5.2 No Guarantee of Availability. WE DO NOT WARRANT THAT KODA WILL BE AVAILABLE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE THAT ALL FEATURES WILL FUNCTION INDEFINITELY OR THAT ANY PARTICULAR FEATURE WILL CONTINUE TO BE SUPPORTED. ACCESS MAY BE SUSPENDED OR DISCONTINUED AT ANY TIME.
5.3 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, EDGEFOX & CO (D/B/A KODA) AND ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE KODA.
5.4 Aggregate Liability Cap. IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) FIFTY U.S. DOLLARS ($50.00) OR (B) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO US FOR PREMIUM SUBSCRIPTIONS TO KODA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
VI. TERMINATION AND SUSPENSION
6.1 Suspension by Us. We reserve the right to suspend, restrict, or permanently terminate your access to the Koda Bot if we determine, in our sole discretion, that you have violated these Supplemental Terms, our Terms of Service, our Privacy Policy, Discord’s Terms of Service, or applicable law, or if your use poses a risk to the security, integrity, or availability of the service.
6.2 Suspension by Discord. If Discord suspends, restricts, or terminates your Discord account or modifies its APIs or policies in a manner that prevents Koda from functioning, your access to Koda will be terminated immediately without liability to us.
6.3 Effect of Termination. Termination may result in deletion of your data in accordance with our Privacy Policy. We are not responsible for maintaining or restoring data once your access is terminated.
VII. GOVERNING LAW AND VENUE
7.1 Governing Law. These Supplemental Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of laws principles.
7.2 Jurisdiction. You agree that any dispute, claim, or controversy arising out of or relating to these Supplemental Terms or your use of Koda shall be brought exclusively in the state or federal courts located within the State of Wyoming. You consent to the personal jurisdiction of such courts and waive any objection based on inconvenient forum.
VIII. SEVERABILITY AND SURVIVAL
8.1 Severability. If any provision of these Supplemental Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
8.2 Survival. All provisions regarding disclaimers, limitations of liability, governing law, dispute resolution, and data handling shall survive termination of your use of Koda.
