Premium Supplemental Terms

 

 

These Premium Supplemental Terms (“Supplemental Terms”) govern your access to and use of premium features and entitlements (“Premium”) provided through the Koda Discord bot and EdgeFox & Co (d/b/a Koda) (“Koda,” “we,” “us,” or “our”).

 

These Supplemental Terms are incorporated by reference into, and form part of, the Koda Terms of Service, Privacy Policy, and Discord Supplemental Terms. By subscribing to, receiving, or using Premium, you expressly acknowledge and agree to these Supplemental Terms in addition to all other applicable agreements.

 

1.1 Service Description. Premium consists of enhanced features, entitlements, subscriptions, and rewards available to users or guilds via Discord Premium Apps or other authorized means. Premium may include advanced commands, boosted limits, exclusive items, economy enhancements, and cosmetic upgrades.

 

1.2 Scope. Premium is available at both the user and guild level. Guild subscriptions may unlock features for all members of a server, while user subscriptions or entitlements apply only to the individual subscriber.

 

1.3 License. Premium entitlements grant a limited, revocable, non-transferable license to access enhanced features within Koda. Premium does not confer ownership of any digital assets or rights beyond permitted use within Koda.

 

2.1 Subscriptions Through Discord. Premium subscriptions are processed exclusively through Discord’s Premium Apps platform. Billing, renewals, cancellations, and refunds are governed by Discord’s terms, not by Koda directly.

 

2.2 Tiers. Premium may be offered in multiple subscription tiers (e.g., “Koda Core” or “Koda+”) with varying levels of benefits. Tier inclusions are subject to change at our discretion.

 

2.3 Duration. Premium subscriptions remain active for the period purchased through Discord. At expiration, premium features will be removed unless renewed.

 

2.4 Refunds. We do not directly process or honor refund requests for Premium purchased through Discord. Refunds must be requested from Discord according to their policies.

 

3.1 Premium Currency. Certain Premium purchases may include virtual coins or credits. Such currency has no cash value and is subject to our Economy Supplemental Terms.

 

3.2 Durable Entitlements. Premium entitlements marked as “durables” (e.g., cosmetic unlocks, permanent buffs) are persistent once granted, unless revoked for violation of these Terms. Durables may not be refunded, traded, or transferred.

 

3.3 Consumable Entitlements. Premium consumables (e.g., loot keys, XP boosters) are one-time-use and expire upon consumption. Consumables may also expire if not redeemed within the specified timeframe.

 

4.1 Complimentary Access. From time to time, we may grant complimentary or “comped” Premium subscriptions, entitlements, or currency. Such access is discretionary and creates no right to future or continued use.

 

4.2 Terms of Use. Comped Premium may include the same or reduced benefits compared to paid Premium. We reserve the right to revoke comped Premium at any time without notice or liability.

 

4.3 Non-Transferable. Complimentary or comped Premium may not be sold, transferred, or exchanged for value. Attempting to do so may result in termination of all Premium access.

 

5.1 Feature Availability. Premium features may include, but are not limited to: higher economy limits, casino enhancements, global chat perks, custom cosmetics, additional storage, or exclusive commands. Features may vary by subscription tier.

 

5.2 Modifications. We reserve the right to modify, rebalance, or discontinue Premium features at any time. Removal or alteration of features does not entitle users to a refund.

 

5.3 Dependencies. Some Premium features may require participation in other systems (e.g., Economy or Casino). Disabling those systems may limit Premium functionality.

 

6.1 No Warranty. PREMIUM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

 

6.2 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO PREMIUM, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF ENTITLEMENTS, OR TERMINATION OF PREMIUM FEATURES.

 

6.3 Balancing Adjustments. We reserve the right to rebalance currency rates, item effects, or Premium perks at any time for fairness and stability. Such changes do not entitle users to compensation or refunds.

 

7.1 By Us. We reserve the right to suspend, revoke, or terminate Premium access for violations of these Supplemental Terms, our Terms of Service, Discord’s rules, or applicable law.

 

7.2 By You. You may cancel Premium through Discord’s subscription management. Cancellation ends at the conclusion of the paid subscription period.

 

7.3 Survival. Provisions relating to disclaimers, limitations of liability, and data handling shall survive termination of Premium access.

 

8.1 Governing Law. These Supplemental Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.

 

8.2 Jurisdiction. Any dispute arising under or relating to these Supplemental Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
